Plain-language summary: SignPayGo is free to use. You own your data. We process payments on your behalf through Stripe. We are not a law firm and cannot guarantee your waivers are legally sufficient for your jurisdiction. Use the platform responsibly and don’t misuse it.
1. Acceptance of Terms
These Terms of Service (“Terms”) are a legal agreement between you and SignPayGo, Inc. (“SignPayGo,” “we,” “us,” or “our”) governing your use of the SignPayGo platform, including our website at signpaygo.com and our application at secure.signpaygo.com (together, the “Service”).
By creating an account, sending a form, or completing a form as a parent or participant, you agree to these Terms. If you are using the Service on behalf of a school, camp, or other organization, you represent that you have authority to bind that organization to these Terms.
If you do not agree to these Terms, do not use the Service.
2. Who May Use the Service
You must be at least 18 years old to create an account as an Organizer. Parents and guardians completing forms on behalf of minors must also be at least 18.
The Service is intended for use by:
- Schools, camps, youth sports programs, and similar organizations (“Organizers”) who create and send forms
- Parents, guardians, and participants (“Respondents”) who complete forms sent by Organizers
By using the Service, you represent that all information you provide is accurate and that you have the legal authority to enter into these Terms.
3. Accounts and Registration
To use the Service as an Organizer, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to notify us immediately at support@signpaygo.com if you suspect unauthorized access to your account. SignPayGo is not liable for any loss or damage arising from unauthorized use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms, are inactive for an extended period, or are associated with fraudulent activity.
4. The Service
SignPayGo provides Organizers with tools to:
- Create digital permission slips, liability waivers, and registration forms
- Collect electronic signatures from parents and participants
- Collect emergency contact and medical information
- Accept payments from parents and participants via Stripe
- Track form completion and payment status through a real-time dashboard
- Export completed rosters and form data
SignPayGo is a software platform, not a legal services provider. We provide tools to help you create and distribute forms, but we do not provide legal advice. The waiver and permission slip templates available in the Service are provided as a convenience only. You are solely responsible for ensuring that any waiver, consent form, or agreement you create through the Service is legally sufficient and enforceable under the laws of your jurisdiction. We strongly recommend that you have your legal counsel review any liability waiver language before distributing it to participants.
5. Pricing and Payments
Free to use
SignPayGo is free to use. There are no subscription fees, no per-form fees, and no per-seat fees.
Payment processing fees
When you collect payments from parents or participants through the Service, a payment processing fee of 3.9% + $0.99 per transaction applies. This fee is charged on each completed payment transaction.
Passing fees to parents
Organizers may choose to pass the payment processing fee to the parent or participant completing the form. This option is available in your event settings. When fees are passed, parents will see the fee clearly displayed before completing their payment.
Payouts
Payments collected through the Service are processed by Stripe and disbursed to your connected bank account on the next business day following the transaction, subject to Stripe’s payout schedule and terms.
Refunds
Refunds are issued at the Organizer’s discretion. Organizers are responsible for communicating their refund policy to parents and participants. SignPayGo will facilitate refunds initiated by the Organizer. Payment processing fees are non-refundable once a transaction has been processed.
Stripe
Payment processing is powered by Stripe. By collecting payments through the Service, you agree to Stripe’s Connected Account Agreement (stripe.com/legal/connect-account). SignPayGo is not a bank and does not hold funds on your behalf.
6. Organizer Responsibilities
As an Organizer, you are responsible for:
- Ensuring that all forms, waiver language, and communications you send through the Service comply with applicable law, including FERPA, COPPA, state privacy laws, and any applicable education regulations
- Obtaining any necessary permissions or consents from your institution before uploading student data
- Using the Service only for lawful purposes and in connection with legitimate organizational activities
- Maintaining accurate and up-to-date account information
- Ensuring that parents and participants have a clear understanding of what they are signing and paying for
- Communicating your own refund, cancellation, and event policies to participants
- Safeguarding any data you export from the Service and handling it in accordance with applicable privacy law
You may not use the Service to collect signatures or payments for events or activities that are illegal, harmful, or deceptive.
7. Respondent Responsibilities
As a parent, guardian, or participant completing a form through the Service, you agree that:
- You are at least 18 years old and have legal authority to sign on behalf of yourself or the minor participant named in the form
- The information you provide is accurate and complete
- Your electronic signature has the same legal effect as a handwritten signature under the federal ESIGN Act and UETA
- You have read and understood the waiver or consent language presented to you before signing
SignPayGo is not a party to any waiver or agreement between an Organizer and a Respondent. Any dispute about the terms of a waiver or the event itself is between you and the Organizer.
8. Electronic Signatures
The Service collects electronic signatures in compliance with the federal Electronic Signatures in Global and National Commerce Act (ESIGN Act) and the Uniform Electronic Transactions Act (UETA). Each signature is accompanied by an audit trail that records the timestamp, IP address, device information, and the exact consent language presented at the time of signing.
Organizers may request a copy of the audit trail for any signed document at any time by contacting support@signpaygo.com.
SignPayGo makes no representation that electronic signatures collected through the Service will be legally sufficient for every purpose or jurisdiction. Organizers are responsible for confirming that electronic signatures satisfy the requirements of their specific use case.
9. Data and Privacy
Your use of the Service is also governed by our Privacy Policy at signpaygo.com/Privacy-Policy, which is incorporated into these Terms by reference.
As between SignPayGo and an Organizer, the Organizer owns all form data, submission data, and participant information collected through the Organizer’s events. SignPayGo processes this data on your behalf and does not use it for any purpose other than providing the Service.
You grant SignPayGo a limited, non-exclusive license to store, process, and transmit your data solely as necessary to provide the Service.
We do not sell participant data. We do not use student data for advertising. We do not share form submission data with third parties except as described in our Privacy Policy.
10. Intellectual Property
SignPayGo and its licensors own all rights in and to the Service, including the software, design, trademarks, and content we create. These Terms do not grant you any ownership interest in the Service.
You retain ownership of all content you create using the Service, including form text, waiver language, event descriptions, and uploaded files. By submitting content to the Service, you grant SignPayGo a limited license to store, display, and process that content solely to provide the Service to you.
You may not copy, modify, distribute, sell, or reverse engineer any part of the Service.
11. Prohibited Uses
You may not use the Service to:
- Collect signatures or payments for illegal, fraudulent, or deceptive purposes
- Impersonate another organization or individual
- Upload or transmit malicious code, viruses, or harmful content
- Harvest or scrape data from the Service
- Interfere with the security or integrity of the Service or its infrastructure
- Violate any applicable law or regulation, including privacy laws and consumer protection statutes
- Use the Service in any way that could damage the reputation of SignPayGo or harm other users
Violation of these prohibitions may result in immediate account termination.
12. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranty of any kind. To the fullest extent permitted by law, SignPayGo disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that any waiver or form template provided through the Service will be legally sufficient for your specific use case or jurisdiction.
13. Limitation of Liability
To the fullest extent permitted by applicable law, SignPayGo and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including lost profits, lost data, or injury to participants at events for which you collected signatures or payments through the Service.
Our total liability to you for any claim arising out of or related to these Terms or the Service will not exceed the greater of (a) the total fees paid by you to SignPayGo in the 12 months preceding the claim, or (b) $100.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.
14. Indemnification
You agree to indemnify, defend, and hold harmless SignPayGo and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or related to:
- Your use of the Service
- Any form, waiver, or agreement you create or distribute through the Service
- Any event for which you collect signatures or payments through the Service
- Your violation of these Terms or any applicable law
- Any dispute between you and a Respondent
15. Third-Party Services
The Service integrates with third-party platforms including Stripe (payment processing), Veracross (student information system), SendGrid (email delivery), and Amazon Web Services (infrastructure). Your use of these integrations is also subject to the terms and privacy policies of those providers.
SignPayGo is not responsible for the availability, accuracy, or conduct of any third-party service. We are not liable for any loss or damage caused by your use of a third-party integration.
16. Termination
You may close your account at any time by contacting support@signpaygo.com. Upon closure, we will delete or de-identify your personal data within 30 days, subject to our data retention obligations described in the Privacy Policy.
SignPayGo may suspend or terminate your account at any time, with or without notice, if we determine that you have violated these Terms, engaged in fraudulent activity, or if required to do so by law. We will make reasonable efforts to provide advance notice where possible.
Upon termination, your right to use the Service ends immediately. Any outstanding payment obligations survive termination.
17. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify Organizers by email and update the “Last updated” date at the top of this page. Your continued use of the Service after the effective date of any change constitutes your acceptance of the updated Terms.
If you do not agree to the updated Terms, you must stop using the Service and may close your account.
18. Governing Law and Disputes
These Terms are governed by the laws of the State of [Your State], without regard to its conflict of law principles. Any dispute arising out of or related to these Terms or the Service that cannot be resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in [Your County, Your State].
Before filing any legal claim, you agree to contact us at legal@signpaygo.com and give us 30 days to attempt to resolve the dispute informally.
19. Miscellaneous
These Terms, together with the Privacy Policy, constitute the entire agreement between you and SignPayGo with respect to the Service and supersede all prior agreements and understandings.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
You may not assign your rights under these Terms without our prior written consent. SignPayGo may assign its rights without restriction.
